Will the Securities and Exchange Commission (SEC) help me?
The Securities and Exchange Commission (SEC) is an agency of the
federal government that is charged with the regulation and oversight of
the securities business. It writes rules governing the issuance of
securities, securities exchanges, and brokerage firms. The Division of
Enforcement of the SEC also
investigates violations of the securities laws and rules. However, as a
law enforcement agency, the SEC is mainly concerned with punishing and
preventing
violations of applicable law and rules, not with helping particular
investors.
The Securities and Exchange Commision will usually not help you get your money back when your stockbroker has been guilty of fraud or misconduct. While you can file a complaint with the Securities and Exchange Commission, the SEC does not conduct stockbroker arbitrations or mediations, and it will not act as your lawyer, advisor, or attorney.
If you wish
recover
your losses , you must file a claim, either on your own or with the
help of an attorney or lawyer, preferably one who is experienced with
representing investors and
conducting investment arbitrations before the NASD. There are many such
lawyers
who are willing to give you a free consultation
without any obligation.
